Terms of Use

These Terms of Use ("Terms") are an agreement between you and the provider of the Dubl app for iPhone (the "App"). They also serve as the end-user licence agreement for the App. The App is free.

1. Who we are

The App is provided by Individual Entrepreneur Dmitrii Chikovinskii (OGRNIP 314385018300179, TIN 380471193017), Russian Federation ("we", "us"). Contact: the form on the support page.

2. Accepting these Terms

You accept these Terms by ticking the box when you sign in. By doing so you confirm that you are at least 18 years old and have full legal capacity. If you do not agree, do not sign in or use the App.

3. What the App does

Dubl helps you edit video from footage you shot: it splits the recording into takes, transcribes speech and assembles a video from it. Part of this work is done automatically, including by third-party speech-recognition and data-processing services. Before your videos are sent for such processing for the first time, the App asks for your permission.

We decide which features the App offers and how they look, and we may add, change or discontinue features.

4. Your account

• You are responsible for keeping access to your device and sign-in account secure. Actions taken through your account are treated as yours;
• You may not share access to your account.

5. Your content

• You keep all rights to the videos, audio and finished edits you upload or create. We do not use your content to train models, in advertising or to promote the App without your separate consent;
• So that the App can work, you grant us a free, worldwide, non-exclusive licence to store, reproduce, process and adapt (edit, transcribe, crop, caption and style) your content, to share it with service providers that help us run the App, and to deliver the result to you — only as needed to provide the App and for as long as the content is stored;
• By uploading content you confirm that you have all rights needed to do so, and that every person whose image, voice or other personal data appears in it has given any consent required by law;
• To the extent permitted by law, you will handle and cover any third-party claims arising from your content or your use of the App.

6. What you may not do

• upload or create content that infringes others' rights or is unlawful, or that shows minors without the consent of their parents or guardians;
• impersonate anyone or create content that misleads people about who said what, without the consent of the person shown;
• use the App for spam, fraud or other unlawful activity;
• access other people's accounts, bypass security measures, or access the App and its servers by automated means;
• reverse-engineer, modify or redistribute the App, or use it or its output to build a competing product or train models, except where the law expressly allows.

7. Automated output

Transcripts, captions, take selection and edit plans are produced automatically. Speech recognition may mishear a word and automated selection may read a line differently than you meant it, so the App shows you intermediate results to check and correct. You decide what to publish and are responsible for it.

8. Availability and liability

• The App is provided "as is" and "as available". We aim to keep it running but do not guarantee uninterrupted operation;
• The App depends on third-party providers, networks and hosting. Their unavailability, sanctions or measures of any government are beyond our control;
• We are not liable for indirect or consequential loss, loss of profit, or loss of content stored only in the App. Keep your original footage;
• Nothing in these Terms excludes or restricts liability that cannot be excluded by law, or affects rights you have as a consumer under the mandatory law of the country where you live.

9. Suspension and account deletion

• We may suspend access, remove content and block an account if these Terms or the law are breached, on a lawful request of authorities, or where needed to protect the App and other users;
• You may delete your account at any time in the App: Account → Delete account. If you cannot sign in, write to us through the form on the support page;
• Deletion is permanent. Save any videos you need beforehand. See the Privacy Policy for how data is deleted.

10. Our rights in the App

We own the App — its code, design, video styles, name and marks. We grant you a free, non-exclusive, non-transferable licence to use the App on Apple devices you own or control, for personal and professional purposes, within these Terms.

11. App Store

• These Terms are between you and us, not Apple Inc. We are responsible for the App and its support;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you;
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", are not on any sanctions or restricted-party list that prevents us from providing the App to you, and will not use the App in breach of applicable sanctions.

12. Changes, governing law and disputes

We may update these Terms and publish the new version on this page with a new effective date. If a change materially reduces your rights, we will tell you in the App or by email at least 10 days before it takes effect and ask you to accept it when you sign in.

These Terms are governed by the laws of the Russian Federation. This does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside. Please contact us through the form on the support page first — most issues are resolved that way. Disputes are decided by the courts of the Russian Federation, unless mandatory law allows you, as a consumer, to bring proceedings in the courts of your country of residence. If any provision is found invalid, the rest remain in force.
